Status and role of public guards in environmental protection Abstract The thesis deals with the status of public guards within the legal system of the CZE and the role of public guards in environmental protection. The aim of this thesis is to provide a relatively comprehensive analysis of the current legal regulation of individual public guards operating in the relevant sections of environmental protection, and to make de lege ferenda proposals leading to the improvement of the effectiveness of public guards, based on the confrontation of the current legal regulation with the shortcomings that public guards face in the performance of their activities in practice. According to the current legislation, there are four types of public guards. Public guards are divided into hunting guards, fishing guards, forest guards and nature guards, which are further divided into wardens and correspondents. Furthermore, the public guards themselves can be either voluntary, who perform their duties on a voluntary and honest basis, i.e. in their own time and without remuneration, or professional, who perform their duties in the context of an employment relationship. This diploma thesis deals with public guards and the role they have in environmental protection. Firstly, the thesis focuses on the explanation of the concept of public guards, their historical development and present legal regulation. Secondly, the thesis deals with particular public guards, which are hunting guard, forest guard, fishing guard and nature guard. Their legal regulation and evaluation of their work is discussed in separate chapters. The next part of the thesis is concerned with The Public Guards Bill 2002. Finally, the thesis deals with a critical evaluation of the role that public guards have in environmental protection and proposes several solutions for the improvement of their work. The aim of this thesis is to provide a comprehensive analysis of public guards and to suggest solutions for the improvement of their activities.

Public guards and their roles in nature protection Summary The purpose of my thesis is to analyze the position and roles of the public guard in the Czech Republic. The thesis is composed of six chapters, each of them dealing with different aspects of the public guard. Chapter One is introductory and defines the institution of the public guard. Chapter Two is dealing with history of the public guard. Chapter Three and Four examine the position, the legislation and the role of public guard in the Czech Republic. Chapter Five illustrates the approach to the instituion of the public guard in Slovak Republic, Poland and Hungary and compares legislation with each other. Conclusion are drawn in Chapter Six. The main aim of thesis is to analyze the position and roles of the public guard, compare it with legislation, roles and with the position of the public guard in Slovak Republic, Poland and in Hungary. Finally I try to suggest legislative changes, that will improve the functioning of the public guards. The article 35 of the Basic Charter of rights and freedoms of the Czech Republic establishes the right of each person to the favourable environment and the obligation of each person to protect the environment. The aim of this thesis is to analyze the current legal regulations of public guards and outline possibilities of its development de lege ferenda. This thesis consists of 7 chapters (including the introduction and conclusion), and these chapters are further divided into subsections. After the introduction follows chapter, which defines the basic concepts (public guards and environmental protection). The third chapter deals with the historical development of public guards. In the fourth, the largest chapter of this work is comprehensively described, analyzed and as knowledge of the practice confronted by applicable law of public guards. The following chapter deals with a brief insight into foreign legal regulations of environmental protection (France, Italy). The sixth chapter presents legal regulations de lege ferenda. In conclusion, there are actually assessed, identified and summarized considerations de lege ferenda.
